Warranty Information
The Dashaway Company warrants that the Dashaway® will
be free from defects in materials and workmanship under normal use and
conditions for a period of one (l) year from the date of purchase, except as
noted below. This warranty is for the original retail purchaser, is
non-transferable and applies only to products purchased directly from the
Dashaway Company or an authorized dealer. This warranty shall apply only if the
product is put to the use intended by the manufacturer.
THIS ASSISTIVE DEVICE IS WARRANTED TO BE SPECIFICLLY FIT FOR THE
PARTICULAR NEEDS OF YOU THE BUYER. IF THE DEVICE IS NOT SPECIFICALLY FIT FOR
YOUR PARTICULAR NEEDS, IT MAY BE
RETURNED TO THE SELLER WITHIN 30 DAYS OF THE DATE OF ACTUAL RECEIPT BY YOU OR
COMPLETION OF FITTING BY THE SELLER, WHICHEVER OCCURS LATER. IF YOU RETURN THE
DEVICE THE SELLER WILL EITHER ADJUST OR REPLACE THE DEVICE OR PROMPTLY REFUND THE
TOAL AMOUNT PAID. THlS WARRANTY DOES NOT AFFECT THE PROTECTIONS AND REMEDlES
YOU HAVE UNDER OTHER LAWS.
THlS WARRANTY GIVES YOU SPECIFIC LEGAL RlGHTS AND YOU MAY HAVE
OTHER RIGHTS THAT VARY FROM STATE TO STATE.
Parts or materials which are subject to normal wear resulting from
the use of this product, and which must be replaced or repaired due to such
normal wear, are the owner's responsibility and are not covered by this
warranty. This warranty does not cover cosmetic damage and damage to any part
of the product which results from accident (including in transit), or repairs
or attempted repairs by any person not authorized by the Dashaway Company, or
by vandalism, negligence, misuse, abuse, affixing an unauthorized accessory,
improper storage or handling, improper operation or maintenance or alteration
to the product.
This limited Warranty constitutes the Dashaway Company's only
responsibility and obligation to repair and/or replace materials and
components, at its option. Except for the express warranty stated herein, the
Dashaway Company, disclaims all other warranties, express or implied, including
but not limited to implied warranties of merchantability and fitness for a
particular purpose. The Dashaway Company will not be liable for any loss or
damage, including incidental or consequential damages of any kind, whether
based upon warranty, contract or negligence and arising in connection with the
sale, use or repair of the product. Some states do not allow the exclusion or
limitation of implied warranties, incidental or consequential damages, so the
above limitations and exclusions may not apply to you. The duration of any
applicable implied warranties shall not exceed in duration the term of this
limited warranty.
Should service be necessary due to manufacturing defect or
malfunction during the warranty period, you must provide us with a copy of
proof of date of purchase by the original owner. Upon satisfactory proof of the
date of purchase by the original owner, the Dashaway Company will repair or
replace, at its discretion, the defective merchandise at no charge. The
Dashaway Company reserves the right to substitute materials or models of comparable
quality.
To obtain service under this limited warranty, call our customer
service department at 1-866-968-3274. If we determine the need to replace or
return a part, we will either ship a replacement part to you or send you a
Return Authorization accompanied with a packing slip for you to enclose when
shipping the product to us, freight prepaid. No returns will be accepted
without a Return Authorization and packing slip. No collect shipments will be
accepted. For your protection, insure all packages for shipping.
ANY MODIFICATIONS MADE BY THE USER TO THE PRODUCT WILL RENDER THIS
LIMITED WARRANTY NULL AND VOID. THIS LIMITED WARRANTY IS VALID ONLY IN THE UNITED STATES OF AMERICA.
